The CheckMate application (the “App”) is an online application owned and operated by Brem Foundation to Defeat Breast Cancer (“ Brem Foundation”) that is intended to help users evaluate and understand their risk of breast cancer.

Your use of the App shall be, at all times, subject to these Terms of Use (“Terms of Use”). By using the App, you are agreeing that: (i) you have read these Terms of Use and (ii) you will be bound by these Terms of Use. These Terms of Use may be amended or updated from time to time. It is your responsibility to read and check these Terms of Use prior to your use of the App.

We respect your privacy and the nature of the confidential information that may be obtained or provided in connection with the App. You can view the App’s Privacy Policy here. By using the App, you agree to the Privacy Policy and any modifications thereto.

I. Authorized Users; Maintenance and Access

The App contains certain confidential and non-public information and is intended only for use by authorized users. Information uploaded to the App supports research that improves ongoing credentialing and certification processes.

We reserve the right to perform routine system updates and maintenance. We reserve the right to terminate access to the App at any time, in whole or in part, at our sole discretion. We reserve the right to terminate, suspend, or modify your access to the App at any time.

II. Permitted and Prohibited Uses of the App

The App does not and is not intended to provide any medical or financial advice. In addition, you may not use the App for commercial purposes. In addition, you agree not to use the App in any way that violates any applicable federal, state, local, or international law or regulation.

You further agree not to attempt to gain unauthorized access to, interfere with, damage, or disrupt in any way any parts of the App, or any server, computer, user, or database related to or connected with the App. You may not compromise the App or gain unauthorized access to any portion of the App.

III. Intellectual Property Rights

The App and all, functionality, and features are protected under United States and international copyright law, trademark law, patent law, and other intellectual property laws. All trademarks, names, logos, slogans and the like are the proprietary marks of the respective owners. No trademarks or any content, graphics, and designs appearing on this App may be used in any way without express written from the respective owner(s). No reproduction of any part of the App may be made or used except as expressly permitted herein. No other license or right is granted. You may not remove or alter any copyright or other legal notice from copies of materials from this App.

The App is provided solely as an educational resource to its users. No healthcare decisions should be made solely based on the survey results provided by the App.

VI. Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the State of Maryland, as it is applied to agreements entered into and performed within that State. Any action brought to enforce this agreement or matters related to the website shall be brought in courts of Maryland.
